MGE Digital Canada Inc., its subsidiaries and affiliates (collectively “MDC”, “us”, or “we”) are committed to ensuring you have the very best experience when using our Eligible iGames (as defined herein).
You have a right to know how your Personal Information is collected and what we do with it, so that you can make informed choices. The purpose of this Privacy Policy is to explain in plain terms what we will do, and what we will not do, with your Personal Information (as defined herein).
This Privacy Policy describes MDC’s policies and procedures for the collection, use, and disclosure of Personal Information (as defined below) in connection with your use of the mobile applications (“Apps”), online and mobile games, being prescribed online lottery schemes iGaming Ontario is authorized to conduct and manage pursuant to, and as set forth in, Ontario Regulation 517/21 made under the Alcohol, Cannabis and Gaming Regulation and Public Protection Act, 1996 (Ontario) (the “Act”) and the Act itself (“Eligible iGames”), your participation in loyalty programs (“Rewards”), promotions and giveaways that may be sponsored by either us or third party companies (“Promotions”), your interactions with the server software, web technologies and branded websites used to provide the Eligible iGames, Rewards and Promotions (collectively, the “Platform”), any communications you may have with MDC related thereto and any other related services (collectively, the Apps, Eligible iGames, Rewards, Promotions, and the Platform are referred to as the “Service”) provided by MDC.
As part of its conduct and management of prescribed online lottery schemes in Ontario, iGaming Ontario collects your gaming-related Personal Information under the authority of section 4 of regulation Ontario Regulation 722/21 made under the Alcohol and Gaming Commission of Ontario Act, 2019, S.O. 2019, c. 15, Sched. 1 (“AGCO Act”), and manages your gaming-related Personal Information in accordance with the Ontario Freedom of Information and Protection of Privacy Act, R.S.O 1990, c. F31 (“FIPPA”).
MDC operates the Service as part of the open and regulated internet gaming market in Ontario conducted and managed by iGaming Ontario, and collects, uses and discloses gaming-relating Personal Information on behalf of, and as agent to, iGaming Ontario. The legal authority under which MDC collects Personal Information on behalf of, and as agent to, iGaming Ontario includes FIPPA, Ontario Regulation 722/21 made under the AGCO Act, and Article 13 of the Operating Agreement between iGaming Ontario and MDC (the “Operating Agreement”). This Privacy Policy has been prepared in accordance with iGaming Ontario’s Privacy Directive, the requirements of which MDC acknowledges and has adopted.
We are also subject to Canada’s Personal Information Protection and Electronic Documents Act, S.C. 2000, c.5 (“PIPEDA”), which governs how MDC may collect, use and disclose your non-gaming-related Personal Information.
In this Privacy Policy, the term “Applicable Privacy Laws” will refer to the privacy and freedom of information laws as they apply to MDC.

1. PERSONAL INFORMATION
For
the purposes of this Privacy Policy, personal information means information
about an identifiable individual and includes any information that
constitutes personal information within the meaning of any applicable law
governing the collection, use, disclosure and retention of personal
information, FIPPA, PIPEDA, and any other applicable law or standard of the
Alcohol and Gaming Commission of Ontario (“Personal Information”). For
clarity, Personal Information includes but is no way limited to your name,
address, verification/authentication data, payment data, contact details,
transaction records, and identification numbers. For the purposes of this
Privacy Policy, Personal Information does not include business contact
information (to the extent that it is excluded from the application of
Applicable Privacy Laws), or aggregate and/or de-identified data that does
not relate to an identifiable individual and cannot be reverse engineered
alone or in combination with other available information.
2. CONSENT
You
acknowledge and agree that by using the Service, playing any Game,
participating in any Rewards or Promotions, downloading and installing any
App, or otherwise interacting with MDC, you fully understand, accept and
voluntarily consent to the collection, use, retention and disclosure of
Personal Information in accordance with this Privacy Policy. It is always
your choice whether or not you provide us with your Personal Information. By
providing us with your Personal Information, you are actively consenting to
this Privacy Policy and to the collection, use and disclosure of Personal
Information as outlined herein. However, a decision to withhold Personal
Information may restrict or prevent us from providing you with a particular
product or service. We will only use Personal Information for the purpose
for which it is collected or consistent purposes in accordance with
Applicable Privacy Laws. We will only collect, use, and disclose your
Personal Information with your consent, except where otherwise permitted or
required by applicable law or regulatory requirement. If you have any

3. COLLECTION OF INFORMATION
We
collect Personal Information in a variety of ways, including directly from
you, from other sources, through online technologies (such as when you are
interacting with us through our Platform and Apps) and from third-party
social networks. In this Section, we describe the types of Personal
Information we may collect and the manner in which such information may be
collected.
In
addition to the above, we will need to verify your identity in order for you
to use some aspects of the Service. For such purposes we will verify your
identity with a credit bureau and, we may also collect the following
personal information from you (for compliance reasons, provision of this
information, when requested, is a mandatory condition of using our Service).
This is not a credit check and will not affect your credit rating or credit
score.”

Registration Information. When you create an account (“Account”), we may
collect the following Personal Information directly from you (“Registration
Information”):
- Name;
- Username;
- Date of birth;
- Password
- Home address;
- Email address;
- IP address;
- Phone number;
- Payment information;
- Electronic KYC;
- and
- Security questions and responses
b.
Additional Information. From time-to-time, you may directly provide us with
additional information to make public, such as in connection with a
Promotion. Providing such additional information is entirely optional.
c.
Location Information. If you turn on your location information functions, we
may also save exact coordinates to help improve our service. You can control
your location information settings by using your device’s settings to turn
location services on or off for the Apps, however, certain features or
services of our Services, Platform and Apps may be affected or unavailable
if your location services are disabled. We may also use your location
information to enable you to interact with our third party partners
(“Brands”) and other users.
d.
Log Data. Our servers automatically record information (“Log Data”) created
by your use of the Service. Log Data may include information such as your IP
address, browser type, the referring domain, pages visited, your mobile
carrier, device and application IDs, and search terms. Other actions, such
as interactions with our Apps and advertisements, may also be included in
Log Data.
e.
Links. We may keep track of how you interact with links in messages across
our Service including third party services and clients by redirecting clicks
or through other means. We do this to help improve our Service, including
advertising, and to be able to share aggregate click statistics such as how
many times a particular link was clicked on.
f.
Cookies. Like many websites, we use “cookie” technology to collect
additional website usage data and to improve our Service, but we do not
require cookies for many parts of our Service such as searching and looking
at public user profiles or lists. A cookie is a small data file that is
transferred to your computer’s hard disk. We may use both session cookies
and persistent cookies to better understand how you interact with our
Service, to monitor aggregate usage by our users and web traffic routing on
our Service, and to improve our Service. Most Internet browsers
automatically accept cookies. You can instruct your browser, by editing its
options, to stop accepting cookies or to prompt you before accepting a
cookie from the websites you visit.
g.
Social Media. With respect to third party social media platforms, we only
use the APIs, OAuth Tokens, Widgets, or other means provided by the
applicable social media platform to integrate your Social Media Account with
our Platform and/or Apps, as applicable. As such, we only receive the
limited information that each platform permits to be transferred.
h.
Analytics. We may allow others to provide audience measurement and analytics
services for us, to serve advertisements on our behalf across the Internet,
and to track and report on the performance of those advertisements. These
entities may use cookies, web beacons, SDKs, and other technologies to
identify your device when you visit our site and use our Services, as well
as when you visit other online sites and services.

Third Party Service. We use a variety of services hosted by third parties to
help provide our Service, such as hosting our various blogs and wikis, and
to help us understand the use of our Service.

Payment Information. You may be asked to provide credit card or other
payment information in connection with your use of the Service. We encrypt
and securely store all such information.
4. USE OF INFORMATION
a.
Providing Services. We use your Personal Information to facilitate all
services, functions, duties and responsibilities that are reasonably
inherent, necessary or customarily performed or provided in connection
with, or that are necessary for, the proper and secure operation of the
Service or otherwise in connection with the performance of the
obligations, covenants and agreements of MDC set out in the Operating
Agreement, which may include:
- Creating, administering, and maintaining your accounts with us;
- Processing your transactions;
- Verifying your identity;
- Responding to your inquiries;
- Responding to your requests or taking or verifying instructions from you;
- Enabling your participation in surveys or chats;
- Managing your excluded status, whether voluntary or involuntary;b. Managing Our Operations. We use your Personal Information to manage our operations and our business, for example:
- Notifying you of changes to your account or our Services, terms, conditions or policies and to provide you administrative messages, updates, legal notices, technical notices or security alerts;
- Deploying and managing our information technology applications and systems, including managing our Services;
- Maintaining the security of our customers, employees and property;
- Protecting us and third parties from errors and fraud;
- Monitoring and investigating incidents and managing claims, including but not limited to disputes between you and other users;
- Maintaining our Services; and
- Meeting our contractual, legal and regulatory obligations.
c. Marketing and Advertising. We may use your Personal Information to
facilitate marketing promotions concerning our services and those of our
affiliates and third party Brands, including by delivering online
advertisements relevant for you, and by sending email or text messages to
your wireless phone, tablet, or other mobile device (each a “Device”). We
will not send you electronic advertising or marketing messages without your
consent. For more information on your choices, please see the section below
entitled “YOUR RIGHTS”.
d.
Research and Analytics. We may use your Personal Information in order to
conduct market research and data analytics by tracking and analyzing
current or previously collected information for the following
purposes:
- Improving or developing new products, services and promotions, and to better understand our customer base and behavior;
- Managing and developing our business and operations;
- Improving our Services (e.g. improving the Platform and Apps);
- Understanding customer needs and preferences and customizing how we tailor and market services to our customers based on their interests;
- Measuring the effectiveness of our marketing; and
- Understanding how visitors interact with our websites and apps and ensure they work correctly.
- When possible, we will use your information in an aggregated and/or de-identified format.
5. DISCLOSURE OF INFORMATION.
MDC
will not disclose your Personal Information to any non-affiliated third
party without your prior consent, other than as provided in this Privacy
Policy or as otherwise authorized by applicable law.
a.
Affiliates. MDC affiliates may share Personal Information with each
other and use it for the purposes described in this Privacy Policy. This
allows MDC to support the Services provided, including but not limited
to loyalty programs that it administers in cooperation with its
affiliates, allows each entity within the group to comply with
applicable laws, regulations and requirements and ensures that your
information is consistent, accurate and up-to-date.
b.
Service Providers. MDC may use third party service providers to provide
certain services to you and we may share Personal Information with such
service providers, including Pala Interactive LLC (“Pala”). We require
any company with which we may share Personal Information to protect that
data in a manner consistent with this policy and to limit the use of
such Personal Information to the uses set out herein.
c.
Business Transfers. In the event that we are involved in a bankruptcy,
merger, acquisition, reorganization or sale of assets, your information
may be sold or transferred as part of that transaction. In the event the
transaction or transfer is completed, your Personal Information will
remain protected by Applicable Privacy Laws. In the event the
transaction is not completed, we will require the other party not to use
or disclose your Personal Information in any manner whatsoever and to
delete such information, in compliance with applicable laws.
d.
Other Permitted Reasons. Applicable Privacy Laws may permit or require
the use, sharing, or disclosure of Personal Information without consent
in specific circumstances (e.g., when investigating and preventing
suspected or actual illegal activities, including fraud, or to assist
government and law enforcement agencies).We may preserve or disclose any
of your information, if we believe that it is reasonably necessary to
comply with a law, regulation or legal request; to protect the safety of
any person; to address fraud, security or technical issues; or to
protect our rights or property; or as otherwise permitted or required by
law.
e.
Disclosure to Brands. We may share certain portions of your Registration
Information with Brands for marketing purposes, specifically, your name
and email address, along with information that we have collected about
your interests and preferences based on the Game in which you choose to
participate. You may opt out of receiving marketing messages from Brands
by using the opt-out mechanisms and links provided by each Brand. You
can also opt-out of sharing your Personal Information with Brands by
emailing [email protected].
f.
With Your Consent. Other than the purposes listed above, we may, with
your implied or express consent, share or disclose your Personal
Information in accordance with Applicable Privacy Laws.
6. PERSONAL INFORMATION OUTSIDE ONTARIO
Your
Personal Information may in some cases be transferred to jurisdictions
outside Ontario or outside Canada, to service providers or affiliated
organizations. As a result, you understand that your Personal
Information will be subject to the laws of other jurisdictions than
Ontario and may be available to foreign government authorities under
lawful orders and laws applicable in such jurisdictions. Regardless of
the company or person who processes your information and where it is
processed, we will maintain and protect your Personal Information in
compliance with the Laws of the Province of Ontario and this Privacy
Policy.
7. OUR POLICY TOWARDS MINORS
You
must be 19 years of age to use the Service. Our Service is not directed
to people under this minimum age. If you, as a parent or guardian,
become aware that an individual under the applicable minimum age has
provided us with Personal Information, please contact us at

in order to have such information deleted. We do not knowingly collect
Personal Information from individuals under the indicated minimum ages.
If we become aware that an individual under the applicable minimum age
has provided us with Personal Information, we take steps to remove such
information and terminate such individual’s account within a reasonable
time.
8. CHANGES TO THIS STATEMENT
This
Privacy Policy will be continuously assessed against new technologies,
business practices, legal requirements and our users’ needs. As we
update, expand and diversify our products and services, this Privacy
Policy may evolve. Please check this Privacy Policy from time to time
for updates by checking the date of the “Last Update” at the top of this
document. A link to our Privacy Policy will be provided at the bottom of
each web page on our Platform, as well as in the navigation menu of any
mobile application.
If
we make any changes to this Privacy Policy, you will be notified upon
logging-in to the service at which point you will be required to
actively consent to changes in the Privacy Policy by clicking an accept
prompt. If you do not consent or accept the changes, you will no longer
be able to use the Service.
By
continuing to access our Platform, use our Services or otherwise
interact with us after the modified version of the Privacy Policy has
been posted and you have been notified that the Privacy Policy has
changed, you are accepting the changes to the Privacy Policy.
9. SECURITY.
We
employ organizational, physical and technological measures to protect
the confidentiality of Personal Information and to safeguard Personal
Information against loss or theft, as well as unauthorized access,
disclosure, copying, use or modification, in light of, among other
things, the sensitivity of the information and the purposes for which it
is to be used.
These safeguards also apply when we dispose of or destroy your Personal
Information. Identified purposes and regulation-prescribed periods inform
MDC’s retention and disposition policy schedule, which MDC will adhere to
when disposing of Personal Information.
We
use reasonable safeguards to ensure that our service providers protect
your Personal Information wherever it is used or stored. However, you
are the frontline to protecting your own Personal Information. To this
end, require that you not share your login information (username and
password) with any other person. To further assist in your own
protection, the Pala system requires that you create a “strong password”
using the characteristics outlined below. As an additional layer of
optional security, at the time of registration users have the option to
opt-in for two-factor authentication
a. Strong Password Requirements:
- Passwords must be at least eight (8) characters in length;
- Use at least one (1) capital letter;
- Use at least one (1) number; and
- Use at least one “special character” (e.g., ! @ $ % & ?).
Upon discovery of any breach of security regarding Personal Information, MDC will promptly notify impacted users and iGaming Ontario and will aid iGaming Ontario and any related authorities in breach management and handling of any results from such breach. Further, MDC and Pala will conduct internal incident investigations pursuant to Pala’s Security Incident Response Plan to determine appropriate corrective action and remediation measures. All security breaches, internal investigation findings, and corrective actions will be logged on incident reports retained by MDC and Pala.
10. THIRD PARTIES
Third
parties that you connect with directly through hyperlinks or other
information provided on our Site may collect, use or disclose your
Personal Information, or link and combine information about you to other
Personal Information they may have collected on you, to achieve their
own goals and purposes.
When
Personal Information is collected by any such third parties, MDC does
not collect, use or disclose such information, which is subject to the
privacy policies of the third party organization. We do not control the
collection, use or disclosure of such Personal Information and MDC
encourages you to review the privacy policies of such third party
organizations.
11. CREDIT CARD INFORMATION
When
you use a credit card on our website, you are actually using a secure
connection to a third party payment processor.
12. DATA TRANSFER.
The
Service is hosted and all Promotions and Eligible iGames take place
within the geographic territories of Ontario. Accordingly, by submitting
any Personal Information to the Service, you are transferring your
Personal Information to such location, consenting to such transfer, and
agreeing to the jurisdiction of the courts of Ontario.
13. YOUR RIGHTS
Electronic
Communications
You
may opt in to receiving email or text message marketing communications
at the time that you register for our Services, enter our promotions or
any time thereafter through your online account with us. We may also
have your implied consent to send you such marketing electronic
communications under applicable laws.
If
you no longer want to receive e-mail or other electronic messages from
us, you can let us know by using the unsubscribe instructions that will
be included in each electronic message, or in the case of text messaging
services, by texting the word “STOP” in response to such messages.
Please note the following:
- Even if you have opted out of receiving marketing communications from us, we may still contact you for transactional purposes, in compliance with applicable laws (e.g., for customer service or support). We may also need to contact you with questions or information regarding your customer service inquiries; and
- It may take some time for all of our records to reflect changes in your preferences (e.g., if you request that you not receive personalized marketing communications from MDC, your preference may not be captured for a promotion already in progress).You may also send requests about your contact preferences and changes to your information including requests to opt-out of sharing your Personal Information with third parties by emailing [email protected].
Cookie Opt Out
Most
Web browsers are set to accept cookies by default. If you prefer, you
can usually choose to set your browser to remove cookies and to reject
cookies. If you choose to remove cookies or reject cookies, this could
affect certain features or services of our Services, Platform and
Apps.
Withdraw Consent
You
can withdraw your consent for the use of your Personal Information at
any time by notifying us at [email protected].
Personal Information may be retained by us for audit or archival
purposes or as required by applicable federal and provincial
laws.
Access, Correction of Personal Information
If
you are a registered user of our Service, we provide you with tools to
access or modify your Registration Information. You can also close your
account with us. You will be able to reopen your account at any time
after it has been closed. If you wish to request that we delete your
account and any Personal Information associated with us, please contact
us using the information below.
Additionally,
you can request to see your Personal Information. If you want to review,
verify or correct your Personal Information, please contact us using the
information below. Please note that any such communication must be in
writing.
When
requesting access to your Personal Information, please note that we may
request specific information from you to enable us to confirm your
identity and right to access, as well as to search for and provide you
with the Personal Information that we hold about you. We may charge you
a fee to access your Personal Information; however, we will advise you
of any fee in advance. If you require assistance in preparing your
request, please contact us.
Your right to access the Personal Information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the Personal Information that we hold about you. In addition, the Personal Information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices.
In the event that we cannot provide you with access to your Personal Information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.
14. VOICE RECORDINGS
If
you contact us for support or other reasons via telephone, we will
request permission to record the call. If you consent, we will store the
recording and reference it to provide you with better service in the
future or resolve disputes. If you decline, we will not be able to
proceed with the call.
15. KEEPING INFORMATION ACCURATE AND UP TO DATE
Per
Section 40(2) of FIPPA, it is MDC’s responsibility to take reasonable
steps to ensure that Registration Information and Personal Information
obtained as result of your use of the Service is accurate and kept up to
date. However, each user of the Service is also responsible for
providing accurate and current Registration Information and Personal
Information when using the Service.
16. INTERPRETATION
This
Privacy Policy and all related matters are governed solely by the laws
of Ontario and the applicable federal laws of Canada.
This
Privacy Policy does not create or confer upon any individual any rights,
or impose upon us any obligations, in addition to any rights or
obligations imposed the laws of Ontario and Canada, inclusive of the
requirements set by iGaming Ontario. Should there be any inconsistency
between this Privacy Policy and the laws of Ontario and Canada, this
Privacy Policy will be interpreted to comply with the applicable privacy
laws and requirements.
